On the demand for immediate hearing of the cases, Justice Suryakant said that unless someone is going to be hanged, I will not list any case on the same day.

While hearing a case, Supreme Court judge Justice Surya Kant asked, "Does anyone know what the conditions of judges are like? How many hours they work and how many hours they sleep?" Justice Surya Kant made this remark on Wednesday (September 24, 2025) while hearing a petition seeking urgent listing.
According to a PTI report, Justice Surya Kant, along with Justices Ujjal Bhuyan and N. Kotiswar Singh, was hearing the case. Advocate Shobha Gupta informed the bench that a residential house in Rajasthan would be auctioned today, and therefore, the case would be listed today. Justice Surya Kant responded that he would not order a case to be listed immediately on the same day unless someone was being hanged.
Justice Surya Kant said, "I will not list any case on the same day unless someone is about to be hanged. You people don't understand the situation of judges. Do you even know how many hours they work and how many hours they sleep? Unless someone's liberty is at stake, we will not list it on the same day."
Upon repeated requests from Advocate Shobha Gupta, Justice Suryakant asked when the auction notice had been issued. She replied that the auction notice had been issued last week and that a certain amount had already been paid as dues. Justice Suryakant told Advocate Shobha Gupta not to expect the case to be heard for the next few months. However, he later asked the court master to list the case for Friday.
Chief Justice of India Bhushan Ramakrishna Gavai (CJI BR Gavai) usually hears such cases. He sits on a five-judge Constitution Bench. As per procedure, when a judge on a Constitution Bench is busy or unwell, the second-most senior judge hears the cases when they are listed.
